Pretendemos reflexionar sobre la manera en la que los discursos audiovisuales están hilvanando las relaciones entre crisis medioambiental y quiebra de los marcos comunitarios sociales. Partiendo de una metodología híbrida basada tanto en la filosofía del arte (y de la ecología) de Heidegger como del análisis narratológico, proponemos pensar el campo mediante dos modelos: las representaciones mainstream que se basan en la repetición de estructuras narrativas clásicas donde la amenaza climática es un conflicto solucionable mediante una intervención heroica y aquellos (...) textos complejos en los que se exige el replanteamiento de una eco(teo)logía que ponga en su foco la necesidad de reactivar la comunidad. Exploramos las tensiones entre narración y materia en la obra de David Lynch. Partiendo de algunas investigaciones recientes -especialmente los trabajos de Català Domènech y Pacôme Thiellement-, proponemos una aproximación al problema de la materia lyncheana que tome como metodología el análisis formal del discurso. Comenzaremos preguntándonos por el uso mismo de la materia que el director aplica en sus creaciones en relación con el aura benjaminiana. En segundo lugar, propondremos un recorrido cronológico que nos permita explorar cómo ha sido (...) la evolución en su manejo de los materiales a partir de tres posibles etapas: el aprendizaje de los códigos artísticos pretéritos -tanto en lo que toca a la herencia de las bellas artes como al reciente pasado cinematográfico-, la paulatina quiebra de los mismos mediante el recurso del video digital o la cita postmoderna, y finalmente, el replanteamiento de sus propias imágenes en un contexto postdigital. El presente trabajo explora y sistematiza la concepción de lo cinematográfico en la obra de Martin Heidegger desde su primera mención en su bibliografía en 1929 –_Introducción a la filosofía– _hasta sus apuntes personales y sus seminarios de 1944. En primer lugar, pretendemos contribuir a la clarificación de un aspecto apenas tratado en los estudios de su filosofía del arte: su conflictiva relación con el cine, entendido siempre o bien como un proceso de exhibición vinculado con la vertiente nihilista de (...) la técnica o como un entretenimiento banal para las masas. En segundo lugar, pretendemos contextualizar y explorar una colección de textos que pueden ser entendidos como una discusión más o menos explícita con los mecanismos de control cultural de la UFA de Goebbels, tomando como referencia tanto aquellas intervenciones realizadas de manera pública –especialmente su primer seminario sobre _Heráclito _de 1943–, como sus propias anotaciones privadas consignadas en los _Cuadernos negros_, las _Meditaciones _y los _Apuntes_. After compulsory secondary education; many teenagers face the process of choosing a university degree. This process involves uncertainties referred to their personal abilities, interests, social expectations and professional future. The present work is aimed at determining whether the reasons behind the selection of a particular university degree differ depending on the chosen degree. Another objective is determining whether these reasons differ significantly according to gender. The sample comprises 983 students belonging to the area of social and legal sciences at the (...) University of Seville. The obtained results reveal the existence of four main reasons behind the selection of university degrees for which significant gender-related differences were observed: easy degree, job opportunities, high wages and provision of social services. Besides, these seven reasons are observed to differ widely in six of the considered degrees. (shrink)

Studies demonstrating the benefits of ethical behavior at an individual level are scarce. The business ethics literature centers its analysis on unethical behaviors and their consequences, rather than ethical behaviors and their benefits. There is now considerable debate on the role of auditors in society and the function of accounting firms in the free market capitalist system. Specifically, the eminently ethical nature of the auditor’s work has been highlighted. Therefore, the aim of our paper is to show the impact of (...) auditors’ sustained ethical behavior: the trust it generates. This trust results in considerable benefits for the firm due to a reduction in the costs of the partner’s supervision of the auditor. The methodology chosen to validate these claims is a survey of partner of the audit firm in auditing companies. The results of this research confirm the hypotheses raised in the theoretical model. This article proposes a guideline to develop an ontology of software. The first section gives a brief introduction to the importance of such ontology as a possible conceptual grounding for the philosophy of software, philosophy of computing and philosophy of information. The second section presents the background of the scope of this article in terms of both a symbolic and materialistic approach to software. The third section deploys the basic guidelines with the expositions of the two dimensions of software: the (...) serial dimension and the structural dimension. The first dimension consists of three series, while the second in the exposition of the structure of any program. There is a growing interest in improving the teaching–learning process at all levels of education, including higher education. In recent years, university institutions have been taking action to renew and modernize the way in which they teach and learn, making the process more dynamic and closer to the current social reality. Competencies such as the ability to work in a team have become essential for the successful implementation of innovative methodologies in which student participation is particularly relevant. Student acceptance is (...) key to the success of any teaching methodology; however, the influence of group work skills on satisfaction with innovative methodologies such as project-based learning has not yet been tested among university students. Thus, the objective of this study is to explore the association between group work competencies and satisfaction with PBL. A total sample of 359 students from two Spanish universities participated in the research. Our results reveal that there is a significant and positive relationship between competencies related to group work and satisfaction with PBL. In addition, a multiple regression analysis shows that the competencies “Conception of group work,” “Usefulness of group work,” “Planning of group work by teachers,” and “Group norms” increase satisfaction with the use of the PBL methodology. This work expands our knowledge about the role in increasing students’ satisfaction that is played by the ability of college students to work as a team. These findings could also guide teachers interested in new teaching methodologies. (shrink)

Es escasa la investigación sobre las competencias necesarias para educar eficazmente en los primeros años de vida, y sobre los factores que influyen en la adquisición de una identidad docente de calidad para trabajar en Educación Infantil (EI). Los resultados de la presente revisión integradora apuntan que (1) el profesorado excelente de EI atiende a la diversidad de su alumnado, (2) las comunidades de práctica contribuyen a la adquisición de una identidad docente excelente, y (3) ciertas deficiencias en los programas (...) de formación docente y determinados factores contextuales obstaculizan un desempeño docente excelente. The so-called uncontrolled donation after circulatory determination of death (uDCDD) have been implemented in several countries, including Spain and France, to increase the availability of organs for transplantation. These protocols allow obtaining kidneys, livers and lungs of patients who do not survive cardio-pulmonary resuscitation performed in out-of-hospital settings. Simultaneously with the development and recent proliferation of these protocols, some emergency teams have begun to employ unconventional methods of CPR, with still uncertain but promising results. The coexistence of these two possibilities (...) raises some questions: At what point should attempts to save a patient with circulatory arrest be abandoned so that this individual can begin to be considered as a potential organ donor? How to manage potential conflicts of loyalties that may arise within emergency and procurement teams? How should the information to the families of those patients and potential organ donors be managed? This article gathers the conclusions of a workshop in which an interdisciplinary working group addressed these and other questions related to DCDD and non-conventional CPR. (shrink)

In a profile in the November, 2012 issue of the magazine Architect, activist-architect Raphael Sperry, a founder of the group Architects Planners & Designers for Social Responsibility discussed his petition to amend the AIA’s Code of Ethics and Professional Conduct to include a prohibition on “the design of spaces intended for long-term solitary isolation and execution.”1 This issue is both serious and timely. Numerous reports have noted decreasing numbers of antibiotic approvals. To determine the context for this decline, we examined all new molecule entities (NMEs) and new biologic licenses (NBLs) approved by the FDA from 1980–2009, and compared approval rates of the 61 approved antibiotics to trends in other drug classes. We also tracked withdrawals of approved drugs and found more withdrawals for antibiotics than other drug classes. After adjusting for drugs subsequently withdrawn, the record for antibiotic innovation is less dire than (...) previously reported. We also report problems with the quality of the approved antibiotics studied. Future policies providing incentives for new antibiotic development should not be based on simple numerical targets and key provisions should ensure appropriate quality as well as quantity of antibiotic drug innovation. Antibiotic use triggers evolutionary and ecological responses from bacteria, leading to antibiotic resistance and harmful patient outcomes. Two complementary strategies support long-term antibiotic effectiveness: conservation of existing therapies and production of novel antibiotics. Conservation encompasses infection control, antibiotic stewardship, and other public health interventions to prevent infection, which reduce antibiotic demand. Production of new antibiotics allows physicians to replace existing drugs rendered less effective by resistance.In recent years, physicians and policymakers have raised concerns about the pipeline for new antibiotics, pointing (...) to a decline in the number of antibiotics approved since the 1980s. This trend has been attributed to high research and development costs, low reimbursement for antibiotics, and regulatory standards for review and approval. Professional societies and researchers around the world have called for renewed emphasis on antimicrobial stewardship, while also supporting antibiotic research and development through grants, changes to intellectual property laws to extend market exclusivity periods, and modification of premarket testing regulations to reduce antibiotic development time and expenses. The traditional ludomotor activities (LA) are recognized by UNESCO as an intangible piece of cultural heritage. The ethnomotricity analyzes LA in its sociocultural context, taking into account the proprieties of rules or motor conditions (internal logic) and the link with local culture (external logic). The aim of this research was to identify and reveal the distinctive ethnomotor features of LA in order to understand the adaptations that occurred in the social scenario of the Spanish Civil War (1936–1939) in Lleida. The (...) corpus of the research was constituted by 101 LA which were collected from the analysis of 20 semi-structured interviews. An “ad hoc” tool was designed and agreed upon by expert observers. It was comprised of a total of 27 ethnomotor variables related to LA. The experts achieved high reliability [Cohen’s kappa coefficient (κ) and Spearman’s correlation coefficient = 1] when the classification of LA was carried out on two different occasions. Descriptive statistics, cross-tabulations (Pearson’s chi-squared) effect sizes, and two-step clusters were performed by external and internal logic variables. The presence or absence of motor interaction (X2= 9.029;df= 1;p< 0.003;ES= 0.298) was enlightening when comparing LA with and without a war connotation. On the other hand, the hierarchy of variables rested primarily on IL-Domain (Psycho-Coop-Oppo-Coop/Oppo) (PI = 1). Among other singularities, while two-step cluster analysis revealed a corresponding ethnomotor silhouette with cluster 1, with the warlike connotation (n= 48; 96.0%), its homologous structure was expressed (Cluster 2) in the absence of the warlike character (n= 26; 50%). Experimental philosophy offers an alternative mode of engagement for public philosophy, in which the public can play a participatory role. We organized two public events on the aesthetics of coffee that explored this alternative mode of engagement. The first event focuses on issues surrounding the communication of taste. The second event focuses on issues concerning ethical influences on taste. -/- In this paper, we report back on these two events which explored the possibility of doing experimental philosophical aesthetics as public (...) philosophy. We set the stage by considering the significance and current state of efforts in public philosophy, and by introducing the emerging sub-discipline of experimental philosophical aesthetics. Then, we discuss the research and outreach aspects of the two events on the aesthetics of coffee. Finally, we conclude by reflecting on the prospects and potential pitfalls of experimental philosophy as public philosophy. (shrink)

El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

Gonzalo Rodriguez-Pereyra presents an original study of the place and role of the Identity of Indiscernibles in Leibniz's philosophy. The Principle of the Identity of Indiscernibles rules out numerically distinct but perfectly similar things; Leibniz derived it from more basic principles and used it to establish important philosophical theses. Rodriguez-Pereyra aims to establish what Leibniz meant by the Principle of Identity of Indiscernibles, what his arguments for and from it were, and to assess those arguments and Leibniz's claims about the (...) Principle of Identity of Indiscernibles. He argues that Leibniz had a very strong version of the principle, according to which no possibilia are intrinsically perfectly similar, where this excludes things that differ in magnitude alone. The book discusses Leibniz's arguments for the Identity of Indiscernibles in the Meditation on the Principle of the Individual, the Discourse on Metaphysics, Notationes Generales, Primary Truths, the letter to Casati of 1689, the correspondence with Clarke, as well as the use of the Identity of Indiscernibles in Leibniz's arguments against the Cartesian conception of the material world, atoms, absolute space and time, the Lockean conception of the mind as a tabula rasa, and freedom of indifference. Rodriguez-Pereyra argues that the Identity of Indiscernibles was a central but inessential principle of Leibniz's philosophy. (shrink)

La pena natural es una situación paradójica que se puede presentar cuando el autor de un delito, al cometerlo o a causa de éste, ha sufrido un daño igual o mayor al que padecería si el juez de la causa le aplicara la pena estatal prevista para tal conducta. Se da con frecuencia al juzgar ciertos accidentes viales, cuando el acusado ya carga el peso de ser quien, por imprudencia, mató a su pareja o familiar cercano, por ejemplo. Pero ¿en (...) qué situaciones y cómo cabe recurrir a la pena natural? En esta investigación, Manuel Serrano explora las diversas aristas y posturas en pugna que atraviesan este tema, donde se cruzan cuestiones como la idea de la “culpa compensada”, la prohibición de aplicar castigo doble por un mismo hecho (non bis in idem) y la clemencia judicial. El autor desmonta la estructura conceptual de la pena natural, estudia jurisprudencia argentina y recorre producciones teóricas de juristas que se han preocupado por este asunto complejo, profundo y poco abordado del derecho penal. David Benatar argues that being brought into existence is always a net harm and never a benefit. I disagree. I argue that if you bring someone into existence who lives a life worth living (LWL), then you have not all things considered wronged her. Lives are worth living if they are high in various objective goods and low in objective bads. These lives constitute a net benefit. In contrast, lives worth avoiding (LWA) constitute a net harm. Lives worth avoiding are (...) net high in objective bads and low in objective goods. It is the prospect of a LWA that gives us good reason to not bring someone into existence. Happily, many lives are not worth avoiding. Contra Benatar, many are indeed worth living. Even if we grant Benatar his controversial asymmetry thesis, we have no reason to think that coming into existence is always a net harm. (shrink)

When we perform an action because we are complying with the legal command or directive, are we still active, self-governed autonomous agents? In what sense are we still autonomous agents? The task of this study is to explain what legal authority is and the premise of the study is that this question can only be answered through understanding of how legal authority operates upon the (...) agent: if we recognize that legal commands or directives intervene upon, affect and change the agent’s practical reasoning, then we need to understand and explain how this happens. How do we know right from wrong? Do we even have moral knowledge? Moral epistemology studies these and related questions about our understanding of virtue and vice. It is one of philosophy’s perennial problems, reaching back to Plato, Aristotle, Aquinas, Locke, Hume and Kant, and has recently been the subject of intense debate as a result of findings in developmental and social psychology. Throughout the book Zimmerman argues that our belief in moral knowledge can survive sceptical challenges. The common assumption is that works of popular are less serious, less artistically valuable. Popular art is driven by a profit motive; real art, high art, is produced for loftier goals, such as aesthetic appreciation. Further, popular art is formulaic and gravitates toward the lowest common denominator. High art is innovative. It enriches, elevates, and inspires; popular art just entertains. Worse, popular art inculcates cultural biases. It is a corporate tool of ideological indoctrination, making contingent social and economic arrangements seem (...) necessary. Or so the common view holds. In light of these common assumptions, we must ask just what marks the distinction between high art and popular art? Is there really any important difference at all? Is there reason to think that popular is by its very nature aesthetically inferior to high art? In this article, I consider some of the prominent answers to these questions. The discussion is organized around questions concerning two general topics: (1) the nature of popular art, and (2) the putative aesthetic deficiencies of popular art. (shrink)

Thinking is a dynamic process resulting from practices of integration. Thought encounters in openness, wonder, receptivity, and contemplation confer upon us intellectual work that is uniquely our own. Digital patterns, however, distract us from these creative encounters. Our intellectual searching is weakened and fragmented by frenetic consumption of information. We miss out on reason's innate pull toward integration and concrete reality. This book is an invitation to enter into openness, wonder, receptivity, and contemplation with deeper understanding and intentionality. We can (...) do this by considering exemplars, persons who lived out the integrity of their hard-won beliefs, such as Thomas Merton, Eva Saulitis, Malcom X and St. Anselm. Each process of integration is applied also, so that practical knowledge and practice become a way into this intellectual restoration. We need deeper knowledge won in the slow orbit of encounters. Encounters in thought are precisely what each generation needs to apprehend the cosmos, nature, authority, truth, and moral action. Responsibility to this ecologic age requires a reform of reason; this book is just one attempt to convey a way toward this restoration. (shrink)

In most domains of human life, we are willing to accept that there are experts with greater knowledge and competencies that distinguish them from non-experts or laypeople. Despite this fact, the very recognition of expertise curiously becomes more controversial in the case of “moral experts”. Do moral experts exist? And, if they indeed do, are there ethical reasons for us to follow their advice? Likewise, can emerging technological developments broaden our very concept of moral expertise? In this article, we begin (...) by arguing that the objections that have tried to deny the existence (and convenience) of moral expertise are unsatisfactory. After that, we show that people have ethical reasons to ask for a piece of moral advice in daily life situations. Then, we argue that some Artificial Intelligence (AI) systems can play an increasing role in human morality by becoming moral experts. Some AI-based moral assistants can qualify as artificial moral experts and we would have good ethical reasons to use them. (shrink)

Plato's closing reference to the Iliad in the Sophist has been largely overlooked in contemporary scholarship. The reference, a quotation from the confrontation between Glaucus and Diomedes in Book 6, forms part of a broader frame to the dialogue. The frame, with its recurring themes of identification and misidentification, helps us make better sense of the dialogue's final description of the sophist and its central concerns about the relationship between philosophy and sophistry. It also provides a revealing case study of (...) Plato's use of Homer as part of a broader strategy for undermining simple appeals to authority. (shrink)

El daño ambiental ha despertado el interés de la doctrina en Colombia, aunque aún no se aborda con rigor y profundidad. La razón, entre otras, es la omisión de los avances que ha dado el derecho comparado, donde la concepción del rol de las instituciones jurídicas va hasta una comprensión integral del daño a partir de la alteración funcional de los sistemas. Existe hoy cierto consenso respecto al deber ser del régimen de responsabilidad aplicable a esta noción integral del daño (...) ambiental, capaz de hacer frente a los componentes del medio natural y a todos los que lo conforman. El libro busca aportar al estudio del daño ambiental desde los avances antes descritos en la materia. (shrink)

El objetivo de este artículo es realizar una historización del sistema sanitario de Neuquén, concretamente atendiendo a los programas de salud aplicados en esta provincia desde su surgimiento hasta el año 2020. En este marco, en primer lugar, me enfocaré en los lineamientos políticos que definieron las bases ideológicas de las políticas públicas llevadas a cabo en la atención sanitaria neuquina, y, en segundo lugar, examinaré las variables estadísticas publicadas por el sistema de salud provincial referidas a las condiciones materiales (...) de atención médica de la población en general, y de las mujeres indígenas mapuce en particular. There is a tension in Emilie Du Châtelet’s thought on mathematics. The objects of mathematics are ideal or fictional entities; nevertheless, mathematics is presented as indispensable for an account of the physical world. After outlining Du Châtelet’s position, and showing how she departs from Christian Wolff’s pessimism about Newtonian mathematical physics, I show that the tension in her position is only apparent. Du Châtelet has a worked-out defense of the explanatory and epistemic need for mathematical objects, consistent with their metaphysical (...) nonfundamentality. I conclude by sketching how Du Châtelet’s conception of mathematical indispensability differs interestingly from many contemporary approaches. (shrink)
